Welcome to Sensory Toy Warehouse Terms and Conditions. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions as set out below, and you are entering a legally binding contract.
All orders placed online will be treated as an offer to purchase goods from us. We will only accept your offer and, therefore, a contract shall only be made once you are in receipt of the goods. We reserve the right to refuse or reject any offer to purchase at any time.

Applicable Law

This Contract is governed by the laws of England and Wales and each party submits to the jurisdiction of the courts thereof.

Force Majeure

If Sensory Toy Warehouse is prevented or delayed in the performance of any of its obligations under this Agreement by any cause which arises from or is attributable to acts, events, omissions or accidents beyond its reasonable control including but not limited to strikes, lock-outs or other industrial disputes, unavailability of raw materials, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, transport disruption, fire, flood, storm, terrorist attack, nuclear, chemical or biological contamination or sonic boom, then it shall have no liability in respect of the performance of such of its obligations as are prevented by those events.

Data Protection

Any personal data you provide will be held securely and in accordance with the Data Protection Act 1998. We will use your personal data for the purpose(s) in relation to which you have provided it. We may however need to disclose personal data to a third party so that they can provide the service you have requested. We may additionally need to disclose information where there is a legitimate reason for disclosure (such as a court order) but we will ensure that we always comply with the Data Protection Act. Any information about you that we pass to a third party will be held securely by that party, in accordance with the Data Protection Act 1998, and used only to provide services you have requested.
As a data subject you have the right to ask for a copy of personal data about you and to ask for inaccuracies to be corrected.
Whilst we may send you newsletters (if you have selected to receive them) and emails regarding your orders, Sensory Toy Warehouse will never send you emails asking for sensitive information such as passwords, login or payment information.

Severability Clause

Invalidity or unenforceability of one or more provisions of this Agreement shall not affect any other provision of this Agreement.

Exclusion of Liability

Nothing in these terms and conditions shall exclude or limit the Company's liability for (i) death or personal injury caused solely by Sensory Toy Warehouse negligence; (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under applicable law.

Prices

All prices quoted are GBP £ sterling and are inclusive of VAT at the current rate of 17.5%. If this rate changes, we reserve the right to increase or decrease prices accordingly. The prices shown are each item, or per quantity as specified. We reserve the right to change our prices at any time.
If you are an individual or a registered charity eligible for zero rated VAT please contact us for a Declaration Form to complete. If you are in any doubt as to whether you are eligible to receive goods zero-rated for VAT you should consult notice 701/7 VAT reliefs for disabled people or contact the National Advice Service on 0845 010 9000 before signing the declaration. Please note there are penalties for making false declarations.

Back-Orders

If items are not in stock, our site cannot accept back orders. Please re-order again when the items are available. You may like to add these to your ‘Wish List’ to remind you to re-order on your next order! Or please contact us and we will gladly email you when available again.

Payment

All online orders will require payment in full before delivery, through our secure payment service provider, PayPal. Payments can be made using all major Credit and Debit Cards and also by a PayPal Account. If you wish to pay by BACS or cheque, or open a credit account, we simply ask that you contact us first.

Delivery

We always pack really well to ensure your items arrive safely. U.K. Mainland orders received by 10.00 a.m. (Monday to Friday) will be despatched that same day. Our shipping rates are automatically calculated by the weight of your order - under 1kg is despatched via First Class Recorded delivery, and over 1kg is despatched via Interlink Express Next Day service.
'First Class Recorded' is a Royal Mail signed-for service. Generally 1 to 2 days, but not guaranteed. Prices range from £2.50 to £4.00, dependent upon weight.
'Interlink Express' is a signed-for next day service. Friday despatches will arrive Monday. Prices are £6.99 under 10kg, and £7.99 over 10kg. You will be notified by email of a 'one hour window' in which your parcel will be delivered the next day. If you are not available within that one hour time slot allocated, you can simply click on the link to rearrange the delivery to a more convenient day.
U.K. Offshore, including Northern Ireland, Isle of Man, Isle of Wight, Scottish Islands, Scottish Highlands, Scilly Isles and Channel Islands (Jersey, Guernsey, Alderney, Herm & Sark), are despatched via Royal Mail First Class Recorded delivery under 1kg, and Tracked Service over 1kg.
'Tracked' service does not require a signature, but is tracked right to your door. It is generally a 2 to 5 days service, and you can advise a 'Safe Place' to leave your parcel if you have one, such as in the porch, in a shed, or with a neighbour at number(..) - please advise in the message box provided when placing your order.
European & International Destinations:
For overseas orders you are offered a choice of services dependent on the weight and destination: 'Royal Mail Air Post', 'Royal Mail International Signed-For', 'DPD Road Parcel', or 'Interlink Air Express'. Orders may be split into more than one parcel, to enable us to offer you the most cost effective postage price. Shipping costs are always available to view before you commit to purchase, offering you the opportunity to amend or cancel your order at any time before payment. For our full range of shipping costs please click on our 'Site Map' Page and select our 'Delivery Rates'. Please note all rates shown, including postage, include V.A.T. - tax will not be charged on the invoice to non-EU countries or the Channel Islands.

Toy Safety

We take the safety of our products very seriously. All products conform to European safety standards and bear the CE mark. Many products are classified as only being suitable for children over 3 years of age, as they may contain small parts.
CAUTION: We recommend ADULT SUPERVISION AT ALL TIMES with these products due to their sensory nature. Please choose carefully, these items are not intended for heavy and extreme use, so not all items are suitable for every child especially for children who mouth, bite, are robust or take things to their limits, and only you know best! Always check the items for signs of wear or damage before each use.

We appreciate it is sometimes easier and more pleasant to talk to someone. However, as a dedicated e-commerce company, our success has been in being able to offer you the great prices, delivery and service that we do. We can only achieve this by working flexibly, productively and keeping our overheads low. We therefore kindly ask that you contact us by email whenever possible. Goods Return Policy

  • Returns Authorisation Number: Please email us, as no returns will be accepted without our Returns Authorisation Number.
  • Missing Items: Please inspect your purchase as soon as you receive it. Ensure that it is the correct item, in perfect working condition and in the right quantities. If not, it is your responsibility to notify us by email within 2 working days of receipt. You must retain all packaging as this may be required for the enquiry. You must return any incorrect items before delivery of the correct items is possible.
  • Faulty Products: Please contact us if you believe the item you have received has a manufacturing fault or defect. If notified within 7 working days of receipt of the goods, we will issue a full refund, including postage, or send a replacement subject to stock availability. After 7 working days no refund of the purchase price is possible, a credit can be given for a replacement or exchange product if it is within 28 days of receipt of the goods. Please note that we cannot be held responsible for any damages caused by improper or extreme use. Faulty goods must be returned by 2nd class post or Parcel Post within 28 days of receipt for inspection and if necessary, return to the manufacturer.
  • Change Of Heart: In accordance with the Distance Selling Directive you may exercise your right to cancel, if it is within 7 working days of receipt of the goods, and receive a full refund of the purchase price. It is your responsibility to contact us with your decision and obtain a Returns Authorisation Number. Goods must be returned within 28 days of receipt, and be unused, as sold, re-saleable and still in original packaging. The refund is for goods only and any postage and packing costs on sending and returning the item, or cost of services such as gift wrapping, will not be refunded.
  • Non Deliveries: If your parcel does not arrive, we cannot accept liability for goods lost in transit unless we are notified within 7 days from the expected delivery date. Please obtain proof of posting when returning items to us, as we cannot be held responsible for goods lost in transit.
  • Damaged in transit: You must make a note on the carriers delivery consignment note and it is your responsibility to inform us within 2 days.

Security

Sensory Toy Warehouse is committed to providing you with a positive online shopping experience and to protecting your security. Sensory Toy Warehouse uses a secure server, ensuring that your transactions stay private and protected. All payments are redirected to the secure PayPal site, market leaders in fraud protection. Sensory Toy Warehouse does not have access to your Credit/Debit Card or PayPal details.
